Acceptance of terms

By using the orbiTome application ("the App") you fully accept these Terms of Service. If you do not accept them, please do not use the App. Continued use also constitutes acceptance of any updates to these terms.

Minimum age and eligibility

To use orbiTome you must be at least 13 years old. If you are under 18, you declare that you use the App with the consent of a parent or guardian where required by local law. Use is prohibited for anyone previously removed from the service.

Description of the service

orbiTome is a geo-social events radar that lets you discover and create ephemeral events nearby. Events have a limited duration (typically 2 hours) and the App offers privacy features such as Ghost Mode. The service is provided "as is" and may be modified, suspended or discontinued at any time.

Account and access

Access is provided through phone-number verification (OTP code). You are responsible for keeping your access confidential and for all activity carried out through your account. You must provide truthful information and keep your details up to date.

Acceptable use and prohibited conduct

You agree not to use the App for unlawful or harmful purposes. In particular, it is prohibited to:

• post illegal, harassing, defamatory, obscene content or content inciting hatred or violence;
• harass, stalk, threaten or impersonate other people;
• engage in any form of exploitation or sexualisation of minors (see Child Safety section);
• send spam, scams or malicious software;
• collect other users' data without consent or circumvent the App's security measures.

User events and content

You are solely responsible for the events and content you publish. You grant orbiTome a limited, non-exclusive, revocable licence to display such content within the App for the sole purpose of providing the service. Events are ephemeral and are removed automatically on expiry. We may remove content that violates these terms.

Privacy and personal data

The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms. By using the App you consent to the processing of data in accordance with that policy.

Child safety

orbiTome enforces a zero-tolerance policy towards child sexual abuse and exploitation. Prohibited conduct and reporting methods are described in our Child Safety Standards. Violations result in a permanent ban and reporting to the competent authorities.

Intellectual property

The App, the orbiTome trademark, the software, the graphics and the related intellectual property rights belong to the service owner. You may not copy, modify, distribute or decompile the App, except as expressly permitted by law.

Disclaimer of warranties and limitation of liability

The App is provided "as is" and "as available", without warranties of any kind. To the maximum extent permitted by law, orbiTome is not liable for indirect, incidental or consequential damages arising from the use of, or inability to use, the App, nor for the conduct or content of other users. You are responsible for your own safety when attending real-world events.

Suspension and termination

We may suspend or close your account at any time and without notice in case of violation of these terms or behaviour that puts other users at risk. You may stop using the App and delete your account at any time; on logout, local data is removed in accordance with our Privacy Policy.

Changes, governing law and jurisdiction

We may update these Terms; significant changes will be communicated through the App or website. These Terms are governed by Italian law. For any dispute, the court of the consumer's place of residence has jurisdiction where provided by applicable law.
