The conditions for bars, gyms, bookshops, shops and other commercial businesses that publish public events on orbiTome. They apply together with the Terms of Service.
These Terms apply to anyone who uses orbiTome as a commercial business (under «I also use orbiTome as»: «Business») and add to the Terms of Service, in particular to the Organisations section. You accept them in the App before starting the subscription.
The business subscription, orbiTome Business, is bought and cancelled through the App Store or Google Play, under the store's conditions and the paid-features rules of the Terms of Service (Service section): automatic renewal, cancellation in the store settings before the renewal (on the App Store at least 24 hours before), refunds requested from the store. The price and any free trial period are shown in the App before purchase. While the subscription is active, the business publishes public events and its page orbitome.com/org/… is online.
Events open to the public organised by the business or on its premises: concerts, classes, launches, tournaments, meet-ups. The event text is informative and contains at most one link, for example to the booking page. Any welcome for people who arrive with the App, where the feature is available, is a free gift or a perk, never an amount in euros. Promotions of alcoholic drinks, tobacco and smoking products, gambling and betting, and adult content are not allowed; the prohibitions of the Acceptable use section of the Terms of Service still apply.
The subscription does not buy visibility: business events appear like other public events, in the «In town» view, with no prominent positions, and we do not guarantee any number of people reached. orbiTome sells nothing on behalf of businesses: no tickets, paid bookings or other sales in the App. Publishing an event sends no notifications.
The business only sees how many people replied, never who they are, and receives no customer data. The venue's address and the profile data may be visible to everyone: enter only data about the business, never a private address. How we handle data is explained in the Privacy policy.
When the subscription ends, because it is cancelled or not renewed, the business no longer publishes public events and its public page goes offline. If a business breaks these Terms or the Terms of Service, we may revoke its publishing: its upcoming public events are cancelled, its public page goes offline and its profile may be suspended, as provided in the Termination section. Revocation does not cancel the store subscription: cancellation and refunds go through the store.
We may update these Terms; significant changes will be communicated through the App or website. For everything else, including governing law and jurisdiction, the Terms of Service apply.
